Terms of Service

This Terms of Service ("Agreement" or "Terms") is a binding legal contract between you ("You," "User") and "Booking Request" ("We," "Us," "Our," "the Company"), the owner and operator of the "Booking Request" mobile application and associated services (collectively, "the Platform" or "Service").

This Agreement governs your access to and use of the Platform. By downloading, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions of this Agreement. If you do not agree with these terms, you must not access or use the Platform.

Service Description

Booking Request is a technology platform that connects clients seeking services with independent service providers. Our Service facilitates:

  • Service provider discovery and profile browsing
  • Booking requests and appointment scheduling
  • Communication between clients and service providers
  • Invoice creation and management (for service providers)
  • Calendar and availability management

Booking Request acts solely as an intermediary platform. We do not provide, contract for, or guarantee any services offered by service providers on our platform.

1. Definitions

  • "Platform": Refers to the marketplace application and services we provide, which connect Clients with independent Service Providers.
  • "User": Refers to any individual or entity using the Platform, including Service Providers, Guest Clients, and Registered Clients.
  • "Service Provider" or "Provider": An independent third-party professional or business that registers on the Platform to offer their services to Clients.
  • "Client": Any User who searches for, books, or receives services from a Service Provider through the Platform.
  • "Guest Client": A Client who books a service using only phone number verification, without creating a persistent account.
  • "Registered Client": A Client who has completed both phone and email verification, creating a persistent account on the Platform.
  • "Services": The actual professional, home, beauty, or other services offered and delivered by Service Providers, not by the Company.
  • "User Content": Any information, text, profile details, service listings, or other materials submitted, posted, or displayed by a User on the Platform.

2. The Platform's Role and Acknowledgment

Important: You acknowledge that "Booking Request" provides a technology platform to connect users. We are not a service provider, contractor, or employer.

  • Neutral Venue: The Platform is a neutral marketplace. We do not provide or contract for any of the Services listed by Providers. We are not a party to any agreement or transaction between a Client and a Provider.
  • No Endorsement or Guarantee: We do not vet, endorse, guarantee, or control the quality, safety, legality, or suitability of any Provider or the Services they offer. Any profile information is provided by the Providers themselves.
  • Release of Liability: You hereby release the Company from any and all claims, damages, or disputes arising out of or in any way connected with your interaction with other Users or the performance (or non-performance) of any Services. All booking and service arrangements are made at your own risk.

3. User Accounts

Account Responsibility: You are responsible for all activity that occurs under your account and for keeping your login credentials (such as email magic links) secure.

4. Terms for Service Providers

Subscriptions and Fees: As a Provider, you agree to pay the monthly subscription fees associated with your chosen tier. Our current subscription tiers are:

  • $9/month: Up to 10 accepted bookings and 10 created invoices per month.
  • $19/month: Up to 25 accepted bookings and 25 created invoices per month.
  • $29/month: Up to 100 accepted bookings and 100 created invoices per month.

Usage Limits & Upgrades: Your usage of bookings and invoices is tracked separately. If you approach or exceed the limits of your tier, you will be prompted to upgrade. Failure to upgrade will result in the inability to accept new bookings or create new invoices. Usage counters reset on your monthly subscription renewal date.

Provider Warranties: By using the Platform as a Provider, you represent and warrant that you: (a) possess all necessary licenses, permits, and insurance required to legally perform your Services; (b) will provide Services in a professional, safe, and workmanlike manner; and (c) will not misrepresent yourself or your qualifications.

5. License Grant and Restrictions

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose in accordance with this Agreement.

Restrictions: You agree not to reverse engineer, decompile, or otherwise attempt to discover the source code of the Platform. You may not use the Platform for any illegal purpose, to harass others, or to send spam.

6. User Content

You retain ownership of your User Content. However, by submitting User Content to the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display such content for the purposes of operating, promoting, and improving the Platform. You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws.

7. SMS Notifications

SMS Service: By providing your phone number, you consent to receive SMS messages from Booking Request, including but not limited to:

  • Verification codes for account authentication
  • Booking confirmations and updates
  • Appointment reminders
  • Service-related notifications
  • Account security alerts

Message Frequency: Message frequency varies based on your account activity and notification preferences. Standard message and data rates may apply as determined by your mobile carrier.

Opt-Out: You may opt out of receiving SMS messages at any time by replying "STOP" to any message. You may opt back in by replying "START" or by updating your notification preferences in your account settings. Please note that opting out of SMS messages may affect your ability to receive important service-related communications.

Carrier Liability: We are not responsible for any charges or fees imposed by your mobile carrier for SMS messages. Please contact your carrier for information about your messaging plan.

Delivery: While we strive to deliver messages promptly, we cannot guarantee delivery of SMS messages. Factors such as carrier network issues, phone number changes, or device limitations may affect message delivery.

8. Third-Party Services

The Platform relies on third-party services, such as Twilio for SMS notifications. You acknowledge that the Platform's functionality may be dependent on the availability of these third-party services. We are not responsible or liable for any failures, delays, or damages caused by these third-party services.

9. Termination

We may suspend or terminate your account and access to the Platform at our sole discretion, without notice, for any reason, including for breach of this Agreement. You may terminate this Agreement by deleting your account and ceasing all use of the Platform. For Service Providers, termination does not entitle you to a refund of any subscription fees already paid.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall "Booking Request" be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the platform.

Our total aggregate liability to you for any and all claims arising from this agreement is limited to the greater of (i) the total subscription fees paid by you to us in the three (3) months prior to the claim, or (ii) one hundred U.S. dollars ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless "Booking Request" and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Platform or your violation of any term of this Agreement.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Gujarat, India. Any dispute arising from this Agreement shall be resolved exclusively in the state or federal courts located in Surat, Gujarat.

14. Changes to this Agreement

We reserve the right to modify this EULA at any time. We will notify you of any material changes by posting the new Agreement on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Agreement.
